Notice of Effective Date of New Rules for

the Tennessee Board for Licensing Contractors

Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.

The Tennessee Board for Licensing Contractors considered new rules at a regularly scheduled meeting conducted on July 26, 2016. These rules were filed with the Secretary of State on November 17, 2016 and will become effective on February 15, 2017. These rules have been filed as Proposed Rules and will be promulgated without a hearing ninety (90) days from the filing date unless a petition is received by at least ten (10) persons who will be affected by the amendments, or submitted by a municipality which will be affected by the amendments, or an association of ten (10) or more members, or any standing committee of the General Assembly.

These rules create an expedited path to licensure for certain military personnel and spouses. The new rules also provide for the renewal of a license held by a member of the national guard or a reserve component of the United States armed forces called to active duty whose license expires during the period of activation to be renewed for up to one (1) year from the person’s release from active duty without the payment of late fees or other penalties. Finally, these rules provide for the acceptance of military education, training, or experience if the education, training, or experience is determined by the Board to be substantially equivalent to that required for issuance of the license. These new rules apply to both general contractors and home improvement contractors. A full copy of these rules may be viewed online at http://share.tn.gov/sos/rules_filings/11-10-16.pdf.

If you have any questions or concerns about these proposed rules, please contact Laura Martin, Assistant General Counsel, at (615) 741-3072 or electronically at Laura.Martin@tn.gov.
