Notice of Effective Date for New Rules of the Tennessee State Board of Cosmetology and Barber Examiners
Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.
The Tennessee Board of Cosmetology and Barber Examiners approved the rules at the rulemaking hearing conducted on April 7, 2025. The rules were filed with the Secretary of State on September 25, 2025, and will become effective December 24, 2025. The rules have been filed as Rulemaking Hearing Rules and will be promulgated ninety (90) days from the filing date.
The rules are in response to the Department’s retrospective rule review and statutory changes made with the passage of Public Chapter(s) 1060 and 865. Public Chapter 1060 was signed into law on May 28, 2024, by Governor Bill Lee which became effective on July 1, 2024. Public Chapter 1060 created the Cosmetology Licensure Compact. Public Chapter 1060 also repealed the requirement that an individual obtain a high school diploma or a high school equivalency credential as a prerequisite for an instructor’s license; the requirement that private barber and cosmetology schools only admit students that have completed and passed at least two years of high school or received at least a score of thirty-eight percent (38%) on the GED or HiSET examination; and the requirement that barber licensees pay twice the fees that would have been normally collected for the reinstatement of a license that has been expired more than one year but less than three years. Public Chapter 865 was signed into law on May 1, 2024, by Governor Bill Lee which became effective on July 1, 2024. Public Chapter 865 created an alcohol license for restricted retail businesses. The statutory definition of a “restricted retail business” includes licensed barber and cosmetology shops that provide food service for patrons, have no more than twenty seats for food service, and sell alcoholic beverages for consumption on the premises in an amount that does not exceed fifteen percent of the business’s gross sales. Finally, the rules also amend the rules regarding apprenticeship to allow a supervising licensed professional to be the responsible charge of up to 3 apprenticeship students.
