Tennessee State Board of Cosmetology and Barber Examiners Rules Update

Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession. You may have received a similar notice on or about April 12, 2017 regarding these rules. The following rules become effective on June 7, 2017. These rules may impact you as a holder of a license with the Tennessee State Board of Cosmetology and Barber Examiners. Highlights to these new changes are as follows:

New rules affecting schools, qualifications, and licensing

0440-01-.03 - Allows any person holding a valid master barber certification to appear before the board and request to sit for the cosmetology exam. The Board may approve if the individual completes 300 cosmetology school hours at a licensed cosmetology school or holds a master barber registration in Tennessee or another jurisdiction with reciprocity with Tennessee for five continuous years.

0440-01-.06 - Adds a requirement for cosmetology schools to keep copies of all receipts or payments the student has made or received in the student’s files. It also requires documentation for students enrolling in teaching programs that the schools notify the enrollee in writing that one must have been licensed for three continuous years prior to applying for an instructor’s license.

0200-01-.02 - Adds an option for barber schools to offer an apprenticeship curriculum for barber school attendees allowing an applicant to obtain 50% of the required hours for a specific license through classroom instruction and 50% of the required hours under the direct supervision or responsible charge of a licensed professional.

0200-01-.13 - Allows any person holding a valid cosmetology license to appear before the Board and request to sit for the master barber exam. The Board may approve if the individual completes 300 school hours at a registered barber college or holds a cosmetology license in Tennessee or another jurisdiction with reciprocity with TN for five continuous years.

New rules affecting shop requirements and sanitation

0440-02-.01 - Amends the definition of aesthetics.

0440-02-.03 - Allows a manager or designated manager to be away from a cosmetology shop for work breaks. Requires manager’s name and license number to be posted and available to any employee or customer. Allows the manager to manage employees across disciplines if the manager is licensed in at least one discipline that the shop is licensed to offer.

0440-02-.13 - Adds requirement that if a cosmetologist uses a safety razor, each new customer must be treated with a new disposable razor or blade, if the blade is detachable from the handle.

0200-03-.14 - Allows a manager or designated manager to be away from a barber shop for work breaks. Allows the manager to manage employees across disciplines as long as the manager is licensed in at least one discipline that the shop is licensed to offer.
