Notice of Effective Date for New Rules for
Scrap Metal Dealer Registration Program

 

Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law and rules applicable to your profession.


The Scrap Metal Dealer Registration Program (“the Program”) approved the proposed rules at the rulemaking hearing conducted on December 15, 2020. The rules were filed with the Secretary of State on February 22, 2021 and will become effective on May 23, 2021. The rules have been filed as Rulemaking Hearing Rules and will be promulgated ninety (90) days from the filing date.


The proposed rules are in response to a review of the finances and suggestions from the Program’s Self-Sufficiency Hearing before the General Assembly in January 2020 and 2021. Fees for the program have not been updated since 2009, over ten (10) years ago. Specifically, the proposed rule increases the initial scrap metal registration fee from one hundred seventy-five dollars ($175.00) to two hundred dollars ($200.00), and the renewal fee from one hundred twenty-five dollars ($125.00) to one hundred seventy-five dollars ($175.00). Furthermore, the rules eliminate the ten-dollar ($10.00) replacement certificate fee and the ten-dollar ($10.00) request to change address fee, as these two features are available on the licensee portal at no charge.


Typically, all rules related to fees go into effect July 1, if filed by April 1st. However, rules may be exempt from this requirement if it can be demonstrated that the Program did not collect sufficient fees to pay for the cost of the Program in the preceding two (2) years. As the Program has not collected sufficient fees in the two (2) preceding years, these rules will go into effect on their effective date of May 23, 2021.
