Motor Vehicle Commission 2015 Legislative Update

The Tennessee General Assembly has recently made changes to statutes which may impact you as a holder of a license with the Division of Regulatory Boards. These new changes set out in the following Public Chapters specifically amend the Tennessee Code Annotated as follows:

Public Chapter No. 344 (SB0126/HB0132), defines “curbstoning” and allows law enforcement to seize vehicles used in curbstoning. The act also defines the term “closed title” and clarifies an existing provision that it is a disciplinary offense for a motor vehicle dealer to possess a title that is not closed, unless the dealer has an executed consignment form. Public Chapter No. 322 (SB0789/HB0730) allows a licensed motor vehicle dealer to operate one (1) additional business at its established place of business if at least sixty-six percent (66%) of the dealer's established place of business is used for the sale or service, or both, of motor vehicles and if the income derived from the additional business is less than thirty-three percent (33%) of the gross income of the dealership. Public Chapter No. 372 (SB1026/HB1030) allows a motor vehicle producer to sell a vehicle previously leased to an employee to a motor vehicle dealer authorized to sell the same line-make. Public Chapter 466 (SB1098/HB1043) expands the duties of automotive dismantlers and recyclers and scrap metal processors in verifying ownership of a vehicle before purchase and sale to include updating a federal database. The criminal penalties are also expanded for violations of this law regarding scrap motor vehicles. Additionally, this law adds a new biennial fee of five hundred dollars ($500) for motor vehicle dismantler and recyclers required to be licensed by the Motor Vehicle Commission. This fee is effective as of July 1, 2015. The remainder of this law will take effect July 1, 2016. Public Chapter 525 (SB1343/HB1321) enacts the “Tire Environmental Act.” This act creates a new fee on each purchase of a new vehicle to be titled in Tennessee. These fees will be used to fund a tire environmental program administered by the department of environment and conservation. This act takes effect October 1, 2015.
