2017 Legislative Update
Tennessee Scrap Metal Dealer Registration Program
The Tennessee General Assembly has recently made changes to statutes which may impact you as a registrant with the Tennessee Scrap Metal Dealer Registration Program. Pursuant to Tenn. Code. Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession. These new changes as set out in the following Public Chapters specifically amend the Tennessee Code Annotated as follows:
Public Chapter 414, effective July 1, 2017, eliminates the requirement that each employee and location of a registered scrap metal dealer procure a separate registration, although violations of the chapter committed by an employee of a registered scrap metal dealer acting in the scope of their employment are considered a violation by that dealer and the dealer must notify the Department of each location. Further, the Act clarifies that registrants must notify the Department of certain convictions by members of the registered entity. A conviction by a member constitutes a conviction by the registrant. A copy of the new law is available for review on the website of the Tennessee Secretary of State here: http://publications.tnsosfiles.com/acts/110/pub/pc0414.pdf.
