2017 Legislative Update
The Tennessee General Assembly enacted statutory amendments during the 2017 legislative session which may impact licensees of the Tennessee Motor Vehicle Commission.
Public Chapter 306 prohibits a motor vehicle dealer from selling a used motor vehicle at retail until the dealer has obtained a recall database report. Vehicles with a do-not-drive or stop-sale order cannot be sold until repairs are made or the dealer makes certain disclosures, signed by the consumer. The act also contains provision regarding manufacturers compensating franchised motor vehicle dealers for labor and parts required by the manufacturer to perform recall repairs. Public Chapter 25 makes advertising services for the provision of a warranty for a motor vehicle, as defined in § 55-8-101, in a deceptive manner that is likely to cause the owner of the motor vehicle to believe that the advertisement originated from the original manufacturer of the motor vehicle or from the dealer that sold the motor vehicle to the owner a violation of the Tennessee Consumer Protection Act. http://publications.tnsosfiles.com/acts/110/pub/pc0025.pdf
