Proposed Rules for Tennessee Motor Vehicle Commission
On July 31, 2015, the Tennessee Motor Vehicle Commission approved a rule affecting a dealership’s telephone number requirements. This change would amend the Tennessee Rules and Regulations as follows:
Tenn. Comp. R. & Regs. § 0960-01-.21(3) would be amended so that a dealership will be able to satisfy the primary telephone number requirement with a cell phone. This rule is currently pending with the Secretary of State and would become effective September 22, 2016. On January 11, 2016, the Tennessee Motor Vehicle Commission approved a rule affecting the termination of dealerships. This change would amend the Tennessee Rules and Regulations as follows:
Tenn. Comp. R. & Regs. § 0960-01-.06 would be amended so that if a manufacturer or distributor elects to terminate a dealership, or threatens to terminate a dealership, the dealership may petition the Tennessee Motor Vehicle Commission for an order determining whether the termination would be unfair, without due regard to the equities, or without just provocation. The rule requires the manufacturer or distributor be served with the petition and must be a party to the hearing. This rule is currently pending with the Secretary of State and would become effective October 5, 2016. On October 6, 2015, the Tennessee Motor Vehicle Commission approved a rule affecting the sale of salvage, rebuilt ,or salvage history motor vehicles. This new change would amend the Tennessee Rules and Regulations as follows:
Tenn. Comp. R. & Regs. § 0960-01-.29 would establish written disclosure requirements on all motor vehicle dealers who knowingly sell any motor vehicle with a salvage title, a rebuilt title or has any history of being a salvage vehicle. The disclosure must be on a form which is provided in the proposed rule. This rule is currently pending with the Secretary of State and would become effective October 5, 2016. On April 25, 2016, the Tennessee Motor Vehicle Commission approved a rule affecting a dealership’s surety bond. This change would amend the Tennessee Rules and Regulations as follows:
Tenn. Comp. R. & Regs. § 0960-01-.22 would be amended so that the surety bond no longer needs to explicitly name the Tennessee Motor Vehicle Commission as the beneficiary to the surety bond. This rule is currently pending with the Secretary of State and would become effective October 20, 2016.
