Notification of Statutory Changes


Pursuant to T.C.A. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession. As such, the Department would notify you of the following Public Chapters that were passed during this legislative session and the effective dates for each Act:

1. Bill Number: HB1859/SB1915

Synopsis: This Act amends the Fresh Start Act, Tenn. Code Ann. § 62-76-104, by prohibiting a licensing authority from using vague terms, such as good moral character or character and fitness, when denying an application for a professional license based on the applicant’s criminal history. If the licensing authority uses such vague terms, it must also provide an explanation of how the prior conviction directly relates to the applicable occupation, profession, business, or trade, if such prior conviction serves as a basis for the licensing authority's consideration and notice or decision. All other provisions of the Fresh Start Act remain in effect.

2. Bill Number: SB2850/HB2900

Synopsis: This Act amends the Employment Verification for Entitlements Act, Title 4, Chapter 58, Section 103, and makes clarifications to the verification process under the SAVE program. Applicants for a professional license will need to provide proof of claimed status, as outlined in Tenn. Code Ann. § 4-58-103(c)&(d).


Effective Date: July 1, 2024

 

3. Bill Number: SB2588/HB2097

Synopsis: This Act amends Title 62, Chapter 76, Part 1, by adding a new section. This Act requires state regulatory boards within the Department of Commerce and Insurance to issue advisory private letter rulings, upon request, to any affected person who is certified, licensed, or registered by such state entities and programs, regarding any matters under such program's primary jurisdiction.
