Tennessee Board of Cosmetology & Barber Examiners Notification of Statutory Changes

 

Pursuant to T.C.A. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession. As such, the Department would notify you of the following Public Chapters that were passed during this legislative session and their effective dates:

Bill Number: HB0120/SB0216

Synopsis: Requires applicants for barber technician license, master barber license, barber instructor license, cosmetologist license, manicuring license, cosmetology instructor license, aesthetician license, or natural hair styling license to obtain up to one hour of online or in-person training by a nonprofit on domestic violence. This bill requires applicants and licensees to obtain up to one hour of online or in-person training by a nonprofit recognized by the Tennessee Coalition Against Domestic Violence & Sexual Assault on domestic violence that focuses on how to recognize the signs of domestic violence, how to respond to these signs, and how to refer to a client to resources for victims of domestic violence. The board will be responsible for making the online training required available online. Further, the board will have full rights and access to training materials and otherwise have access to offer the training as well.

Synopsis: Removes dual requirement previously under Tenn. Code Ann. § 62-3-123(f) which authorizes the Board to create an apprenticeship path for prospective master barbers, but 123(f)(2)(A) required that the apprenticeship be done under someone who is licensed under both Tenn. Code Ann. § 62-3-110 (the master barber certificate) and Tenn. Code Ann. § 62-3-124 (the barber instructor certificate). Public Chapter 0549 removed this dual requirement and allows an apprenticeship to be done under someone who is licensed under either -110 (the master barber certificate) or -124 (the barber instructor certificate).

Synopsis: Modifies educational requirements that required that all master barber registration applicants be seventeen (17) years of age, obtain a high school diploma, GED®, or HiSET® equivalence. Public Chapter 0549 states schools may only enroll a student who is at least sixteen (16) years of age; and has completed and passed at least two (2) years of high school or received a score of at least thirty-eight (38%) on the GED® or HiSET® examination. Public and vocational schools are exempt from this section, except as provided under Tenn. Code Ann. § 62-3-123(b)(2)(f). Please note that the director and staff will no longer require that barber schools contain proof of a high school diploma, GED®, or HiSET® equivalence in a student’s file.
