Notice of Effective Date for New Rules of the
Tennessee Detection Services Licensing Program
Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.
The Tennessee Detection Services Licensing Program, through the Assistant Commissioner for the Regulatory Boards Division, approved the proposed rules at the rulemaking hearing conducted on June 10, 2022. The rules were filed with the Secretary of State on March 22, 2023, and will become effective June 20, 2023. The rules have been filed as Rulemaking Hearing Rules and will be promulgated ninety (90) days from the filing date.
The proposed rules are in response to statutory changes made with the passage of Public Chapter 294 signed into law on April 30, 2021, by Governor Bill Lee which became effective on July 1, 2021. Specifically, the Alarm Systems Contractors Board and Private Investigation and Polygraph Commission were terminated by this law and the regulation of these professions was given to the Detection Services Licensing Program, which is a Program overseen by the Commissioner for the Department of Commerce and Insurance. These rules are in response to this regulatory change. Additionally, there is a rule amendment proposed to Rule 0090-01-.03, which modifies this rule in a manner to match the exemption for licensed contractors from alarm systems contractor licensure found in T.C.A. § 62-32-305(7).
