Notice of the Filing at the Office of the Secretary of State

of New/Amended Rules for the Tennessee State Board of Architectural and Engineering Examiners

Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.

The Tennessee State Board of Architectural and Engineering Examiners considered new rules at a regularly scheduled meeting conducted on February 11, 2016. These rules were filed with the Secretary of State on October 28, 2016. These rules have been filed as Proposed Rules and will be promulgated without a hearing ninety (90) days from the filing date unless a petition is received by at least ten (10) persons who will be affected by the amendments, or submitted by a municipality which will be affected by the amendments, or an association of ten (10) or more members, or any standing committee of the General Assembly.

These proposed rules are additions, amendments, and deletions to the rules of the Tennessee State Board of Architectural and Engineering Examiners as described as below:

- Chapter 0120-01 is amended to include:

A new rule to allow those architects, engineers, and landscape architects registered in other jurisdictions to use their designation so long as they identify the home jurisdiction they are registered in next to the designation;A rule allowing registration options in Tennessee for those currently or previously registered in other jurisdictions;A modification to the rule regarding the employment references required of registration applicants; andA modification to a rule to incorporate the Board’s policy regarding inactive status.

- Chapter 0120-02 is amended to include:

A rule that adds a registrant’s providing of false testimony or information to the Board as a specific grounds for a finding of misconduct;A rule specifying that all registrants working on a project must stamp their portion of the project and that preliminary, draft, or partial plans be marked as such;A rule that makes the ranges of civil penalties for violations of the law or rules uniform; andA rule that sets the minimum passing score for the law and rules exam at 80%.

- Chapter 0120-04 is amended to include:

A rule that adds a registrant’s providing of false testimony or information to the Board as a specific grounds for a finding of misconduct;A rule that makes the ranges of civil penalties for violations of the law or rules uniform;A rule that sets the minimum passing score for the law and rules exam at 80%; andThe repealing of the rule that allowed Registration without Examination as an Interior Designer because that process is now obsolete.

- Chapter 0120-05 is amended to include:

A rule that allows continuing education credit to be awarded for work on a patent that was granted or authoring accepted licensing examination items;Rules limiting the number of professional development hours to be awarded for work on papers, articles, books, patents granted, or licensing examination items; andA rule reducing the time a registrant has to make up disallowed professional development hours from 180 days to 90 days after notice from the Board.
