Notice of New Cemetery Rules for Burial Services
Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.
The Tennessee Burial Services Program considered new cemetery rules at a Rulemaking Hearing conducted on December 12, 2013 and were filed with the Secretary of State on November 14, 2014. These rules will become effective on February 12, 2015.
The rules add a definition for “Director,” add a paper size requirement, and add a requirement that cemeteries report certain changes, including changes of compliance personnel and convictions of a felony or any misdemeanor involving fraud, dishonesty or moral turpitude by a person with an ownership or financial interest in the cemetery, to the Department. The rules also amend the requirements for an application for a community cemetery exemption. Finally, the rules create a code of professional conduct in compliance with Tenn. Code Ann. § 46-1-306(a)(7).
