Notice of Effective Date for New Rules for
Tennessee Real Estate Appraiser Commission

Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.

The Tennessee Real Estate Appraiser Commission approved proposed rules at their regularly scheduled meeting conducted on January 13, 2020. These rules were filed with the Secretary of State on April 9, 2020 and became effective on July 8, 2020.

The proposed rules are in response to an audit finding of the Appraisal Subcommittee (“ASC”) this past January. In summary, the proposed rules amend the Uniform Standards of Professional Appraisal Practice (“USPAP”) instructor recertification course requirements. As amended, the rules remove the title and hour amount for the USPAP instructor recertification course. Furthermore, the rules will allow USPAP instructors that teach the USPAP Update Course to receive continuing education credit for teaching the course. Finally, the rules remove the requirement that failure to take the USPAP update course will result in the imposition of civil penalties up to one thousand dollars ($1,000.00) as this provision of the rule has been interpreted by the Office of the Attorney General to not be authorized by Tenn. Code Ann. § 62-39-326.
