Notice Effective Date of Rules for the
Tennessee Debt-Management Services Registration Program
Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.
The Tennessee Debt-Management Registration Program filed Proposed Rules with the Secretary of State on October 28, 2016, and these rules are effective as of January 26, 2017.
These additions, amendments, and/or deletions to the rules of the Tennessee Debt-Management Services Registration Program include:
- Rules 0780-08-01-.01 through 0780-08-01-.13 are transferred to 0780-05-18-.01 through 0780-05-18-.12 and 0780-05-18-.17 to move them under rules related to the Division of Regulatory Boards.
- New Rule 0780-05-18-.13 provides for a process to submit electronically scanned fingerprints instead of using fingerprint cards.
- New Rule 0780-05-18-.14 provides the calculation for an increase to the registration fee under the Uniform Debt-Management Services Act in accordance with inflationary adjustment based off of the consumer price index.
- New Rule 0780-05-18-.15 clarifies acceptable accreditation for the purposes of registration as a debt management services, as well as establishing the process for approving an independent accrediting organization to provide accreditation.
- New Rule 0780-05-18-.16 clarifies acceptable certification for the purposes of being a certified counselor and/or certified debt specialist, as well as establishing the process for approving an additional certifying organizations or training programs.
