2015 Legislative Update

The Tennessee General Assembly has recently made changes to statutes which may impact you as a holder of a license with the Division of Regulatory Boards. These new changes set out in the following Public Chapters specifically amend the Tennessee Code Annotated as follows:

Public Chapter No. 500 (SB0127/HB0024) creates the “Go Build Tennessee Program” to develop a statewide program designed to educate students in secondary and post-secondary schools of all the job opportunities available in the construction industry. The program will be administered by a non-profit corporation, funded by the Board for Licensing Contractors, and overseen by the Tennessee Department of Labor and Workforce Development. This law is effective as of May 20, 2015. A copy of the new law is available for review on the website of the Tennessee Secretary of State here: http://www.tn.gov/sos/acts/109/pub/pc0500.pdf.

Public Chapter No. 290 (SB0078/HB0290) amends the Board for Licensing Contractor’s current citation issuance law for unlicensed activity, which includes performing work in excess of the licensed monetary limit or in a classification other than licensed. A citation may be issued in an amount up to $1,000 and if the cited party fails to respond or does not contest the citation after being served, the Executive Director of the Board for Licensing Contractors may apply to the appropriate court for a judgment. This law also increases the Board’s citation authority under the Home Improvement Law from $250 to $1,000 and for certain other violations of that law from $500 to $1,000. This law is effective as of April 24, 2015. Public Chapter No. 291 (SB0081/HB0071), this amendment combines the funds received by the Board for limited licensed electricians and limited licensed plumbers.
