Notice of New Rules for the

Tennessee Board of Funeral Directors and Embalmers

Pursuant to Tenn. Code. Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.

The Tennessee Board of Funeral Directors and Embalmers considered new rules at its May 6, 2014 regularly scheduled meeting. These new rules were adopted in accordance and compliance with Tenn. Code Ann. § 4-3-1304(d), (e), and (f), and the General Assembly’s 2013 Public Chapter 122. These rules address licensing for certain qualified members of the military and military spouses.

These rules were adopted as Proposed Rules under Tenn. Code Ann. §§ 4-5-202 and 4-5-207.  These rules were filed with the Secretary of State on August 5, 2014.  A copy of the new rules is available on the Secretary of State’s website at http://www.tn.gov/sos/rules_filings/08-07-14.pdf.  These rules will be promulgated on November 3, 2014 without a hearing unless twenty-five (25) persons affected by the rule, an association with at least that many members, a municipality, or a majority of any standing committee of the General Assembly requests a hearing.  If the Board does not receive a sufficient petition for a hearing by November 2, 2014, then the rules will become effective on February 1, 2015.

Additionally, rules that were the subject of a previous rulemaking hearing by the Board were filed with the Secretary of State on June 2, 2014 and will become effective on August 31, 2014. These rules are available on the Secretary of State’s website at http://www.tn.gov/sos/rules_filings/06-03-14.pdf. These rules change renewals fees, add requirements for apprenticeship quarterly reports, add a factor in the civil penalties rule, discuss requirements for a crematory, and add two professional conduct rules.
