Auctioneer Commission 2015 Legislative Update

The Tennessee General Assembly has recently made changes to statutes which may impact you as a holder of a license with the Division of Regulatory Boards. These new changes set out in the following Public Chapters specifically amend the Tennessee Code Annotated as follows:

Public Chapter 291 (SB0081/HB0071) adds a new definition for “Principal Auctioneer”. “Principal Auctioneer” is defined as the auctioneer who is responsible for the management and supervision of a firm. This act became effective April 24, 2015. A copy of the new law is available for review on the website of the Tennessee Secretary of State here: http://www.tn.gov/sos/acts/109/pub/pc0291.pdf.

Public Chapter 52 (SB0036/HB0244) establishes that the exempt community foundation sales shall take place during no more than two auctions, lasting up to 24 hours, rather than one auction, lasting up to 48 hours, in any calendar year in each county.  This act becomes effective July 1, 2015.  A copy of the new law is available for review on the website of the Tennessee Secretary of State here: http://www.tn.gov/sos/acts/109/pub/pc0052.pdf.
