Notice of Rulemaking Hearing for New Rules of the
Tennessee Auctioneer Commission

Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.

The Tennessee Auctioneer Commission will be conducting a Rulemaking Hearing on Monday, May 16, 2022, at 9:00 a.m. CST. This rulemaking hearing will be held at the following address:

The Tennessee Auctioneer Commission approved proposed rules at their regularly scheduled meeting conducted on November 15, 2021. The Notice of Rulemaking Hearing was filed with the Secretary of State on February 3, 2022.

The proposed rules amend certain requirements for public automobile auctioneers. Specifically, following a statutory change that went into effect on October 1, 2021, the rules amend the age requirement for application from twenty-one (21) to eighteen (18) years of age. Additionally, the rules clarify the licensure requirement for public automobile auction licenses. The Auctioneer Commission and Motor Vehicle Commission have dual licensing jurisdiction for public automobile auctioneers and public automobile auctions. An Attorney General Opinion issued in 2009 opined that the motor vehicle dealer license required for public automobile auctions must be issued in the individual name of the public automobile auctioneer. This amendment will provide clarification for public automobile auction and public automobile auctioneer licensees. As written, the rule does not directly address who, or what, is required to be licensed by the Tennessee Motor Vehicle Commission.
