RE: Tennessee State Board of Cosmetology and Barber Examiners 2025 Legislative Session Updates
Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession. As such, the Department would notify you of the following Public Chapter that was passed during this legislative session and the effective date for this law:
Bill Number: HB0862/SB0939 Public Chapter: PC0102, https://publications.tnsosfiles.com/acts/114/pub/pc0102.pdf Synopsis: This law requires that the Tennessee Advisory Commission on Intergovernmental Relations (TACIR) study the economic impact that the cosmetology and barbering professions have in Tennessee. The study shall include information regarding the revenue generated through the services provided and the number of jobs generated by the professions. TACIR may request information and input from the Department of Commerce and Insurance and other appropriate state and local government entities. These entities must comply with TACIR’s requests. Upon competition of the study, TACIR shall report its findings and recommendations, including any proposed legislation, to the chair of the commerce and labor committee of the senate and the chair of the committee of the house of representatives having jurisdiction over cosmetology and barbering. TACIR shall also provide a copy of the report to the legislative librarian. Effective Date: March 28, 2025
Bill Number: HB1330/SB1316 Public Chapter: PC0524, https://publications.tnsosfiles.com/acts/114/pub/pc0524.pdf Synopsis: This law is known as the “Less is More Act of 2025.” This law makes statutory changes regarding board member qualifications, master barber reciprocity, and inspections of schools and shops. In regards to board member qualifications, the law amends T.C.A. § 62-4-103(b)(2)(C)-(E) to allow the Governor to fill the board seats assigned to a manicurist, aesthetician, and natural hair stylist with one of those licensees or a cosmetologist who practices one of those specialties. In regards to master barber reciprocity, the law amends T.C.A. § 62-3-115(a) by replacing the word “nonresident” with “applicant,” which expands the eligibility for master barber reciprocity to qualifying out-of-state license holders residing in Tennessee. Finally, in regards to school and shop inspections, the amends T.C.A. §§ 62-3-128(e), 62-4-118(i) and 62-4-120(h) by removing the requirement that all barber/cosmetology shops and schools be inspected annually. The law states the board shall promulgate rules regarding the subsequent inspections of schools and shops after the initial inspection is performed. Effective Date: July 1, 2025
Bill Number: HB1237/SB1235 Public Chapter: PC0294, https://publications.tnsosfiles.com/acts/114/pub/pc0294.pdf Synopsis: This law prohibits all boards from establishing or operating under race-based policies pertaining to their composition, including policies on affirmative action, racial preferences, or racial quotas. The law also prohibits all boards from using a person’s race, color, ethnicity, or national origin to determine the person’s participation as a member of the board. Effective Date: April 24, 2025
