Notice of Effective Date of New Cemetery Rules for Burial Services
Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.
The Tennessee Burial Services Program considered new cemetery rules at a Rulemaking Hearing conducted on December 12, 2013. These rules were filed with the Secretary of State on November 14, 2014 and will become effective on February 12, 2015.
The rules add a definition for “Director,” add a paper size requirement, and add a requirement that cemeteries report certain changes to the Department: a change of compliance personnel and whether persons with ownership or financial interest in the cemetery are convicted for any felony or a misdemeanor involving fraud, dishonesty or moral turpitude. The rules also significantly change the requirements for an application for a community cemetery exemption. Finally, the new rules add rules of professional conduct in compliance with Tenn.
