Notice of Effective Date for New Rules for
Tennessee Motor Vehicle Commission
Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.
The Tennessee Motor Vehicle Commission approved proposed rules at their regularly scheduled meeting conducted on January 14, 2019. These rules were filed with the Secretary of State on August 14, 2019 and will become effective on November 14, 2019. These rules have been filed as Proposed Rules and will be promulgated without a hearing ninety (90) days from the filing date unless a petition is received by at least ten (10) persons who will be affected by the rule.
These rules amend an existing rule with regard to the contact information provided by applicants and the standards for doors that divide separate businesses in the same building as motor vehicle dealers. The contact information provided by applicants will now include an email address. As to the conjoining door matter, currently, a permanent wall or sealed door is required to separate a non-motor vehicle dealer business from licensed motor vehicle dealers sharing one building. This amendment will allow a locked door between the businesses that shall not be used by consumers. This amendment provides an option to the current rule for businesses to avoid the expense of fully sealing off separate businesses and allows businesses in a building with common area access to those areas.
