Notice of Effective Date for New Rules for
Tennessee Board for Licensing Contractors

Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.

The referenced rules were adopted for a rulemaking hearing at the March 31, 2020 meeting of the Tennessee Board for Licensing Contractors (“the Board”) and were approved at a rulemaking hearing on January 26, 2021 during a regularly scheduled meeting of the Board. The rules were filed with the Secretary of State on April 28, 2021 and will become effective on July 27, 2021. Proof of Residential Continuing Education (RCE) will be required as a condition to renew beginning with licenses expiring on January 31, 2022.

These rules establish continuing professional education standards for all licensed contractors, with classifications BC-A; BC-A/r; and residential small commercial BC-A,b(sm) after January 1, 2009.

These rules provide that residential licensed contractors licensed on or after January 1, 2009, must complete residential continuing education, a minimum of eight (8) hours biennially, by a board-approved provider. Proof of compliance with this requirement must be filed with the board biennially in the format required by the board, as a condition for the maintenance or renewal of the license beginning with licenses expiring on January 31, 2022. The Board is in the process of adopting Residential Continuing Education (RCE) providers and these will be posted on our website after August 1, 2021 at: https://www.tn.gov/commerce/regboards/contractors.html  This change brings the Tennessee Board for Licensing Contractors into compliance with Tenn. Code Ann. § 62-6-112(g).
